1. Agreement to Terms

By accessing fireispower.com or purchasing any products or services (“Services”) from Combustion & Control Service, LLC (“CCS,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not accept these Terms, do not use the Site or our Services.

2. Changes to Terms

We may update these Terms at any time. Continued use of the Site after a change means you accept the revised Terms. The date of the latest revision appears at the top of this page.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher, to create an account, place an order, or otherwise engage with our Services.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized use. CCS is not liable for losses arising from compromised credentials.

5. Quotes, Orders, and Acceptance

All quotes are non-binding unless and until CCS issues a formal order confirmation. We reserve the right to refuse or cancel any order for any reason, including errors in price or availability.

6. Pricing and Payment

Prices are listed in U.S. dollars and exclude applicable taxes, duties, and shipping fees unless stated otherwise. Payment is processed via Stripe or another secure gateway. We do not store full credit-card numbers.

7. Shipping, Delivery, and Risk of Loss

Shipping dates are estimates only. Risk of loss passes to you upon CCS’s delivery of goods to the carrier. You are responsible for filing any claims with carriers for damaged or lost shipments.

8. Returns and Refunds

Return requests must be made within 30 days of delivery and require a Return Material Authorization (RMA). Custom-fabricated items, used parts, or items not in resaleable condition are non-returnable. Approved returns are refunded in the original payment method minus shipping and restocking fees where applicable.

9. Limited Warranty

CCS warrants that parts we supply will be free from material defects in workmanship for 12 months from the date of shipment unless a different period is specified in the manufacturer’s documentation. Your exclusive remedy is repair, replacement, or refund, at CCS’s sole option. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

10. Professional Use Disclaimer

Our products and field services are intended for commercial and industrial applications. Installation and operation must be performed by qualified personnel who follow all applicable codes and safety standards. CCS disclaims liability for damage or injury resulting from improper installation, operation, or maintenance.

11. Intellectual Property

All content on the Site—including text, graphics, logos, videos, trade names, and software—is the property of CCS or its licensors and protected by U.S. and international intellectual-property laws. No license is granted except for limited, non-exclusive, revocable access to view and use the Site for its intended purpose.

12. Prohibited Conduct

You agree not to:
Violate any applicable law or regulation;
Interfere with or disrupt the Site or servers;
Upload malicious code or attempt to gain unauthorized access;
Use the Site to transmit spam, false information, or infringing content;
Misrepresent your affiliation with any person or entity.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS, OR DOWNTIME COSTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CCS’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless CCS, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or infringement of any third-party right.

15. Compliance with Export Laws

You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. trade sanctions. You will comply with all applicable export-control laws and regulations.

16. Governing Law

These Terms are governed by and construed under the laws of the State of Utah, USA, without regard to its conflict-of-law provisions.

17. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Salt Lake City, Utah, under the Commercial Arbitration Rules of the American Arbitration Association. Judgment on the award may be entered in any court of competent jurisdiction. Nothing prevents either party from seeking injunctive relief to protect intellectual-property rights.

18. Severability

If any provision of these Terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and CCS regarding the subject matter and supersede all prior or contemporaneous understandings, whether written or oral.
